Health and Human Services’ final rule enforcing the ACA’s prohibition against discrimination became effective July 18, 2016. Covered entities were required to comply with the notice and tagline requirements on October 16, 2016. Regulations regarding plan terms will take effect for plan years beginning on or after January 1, 2017.
The Rule is expressly binding on home health care agencies. Its reach extends beyond employees; it also protects clients from illegal discrimination. Discriminatory action barred by the Rule includes that which is based on race, sex, age, religion, spoken language skills and disability.
The webinar presentation described the key components of the new HHS Rule, including its requirements and penalty provisions, and identify recommended practices to maintain compliance.
