On June 30, 2015, the Wage and Hour Division of the U.S. Department of Labor announced a proposed rule which, if adopted, will greatly restrict agencies’ ability to use the executive, administrative and professional exemptions from minimum wage and overtime pay under federal law. In addition to those “white collar” exemptions, the proposed rule also restricts use of the computer employee exemption and the highly compensated employee exemption.
The proposal would more than double the salary/fee required for the white collar exemptions to $921 per workweek, which is $47,892 annually. No one could fall into any white collar exemption unless he or she is paid a salary/fee of at least $47,892 per year.
In addition, the Wage and Hour Division is seeking comments concerning the duties required for the exemptions and, following its review of the comments submitted, may change the duties required when it publishes the final rule.
